What Information Requires Redaction in Discovery Documents?
Discovery redaction covers three distinct categories, each governed by a different legal basis. Confusing them, or applying one standard where another applies, is a common source of over-redaction (which draws sanctions for withholding), under-redaction (which waives privilege or triggers penalties), and failed productions. Understanding which category applies to each document in the set is the first step in getting the production right.
Category 1: FRCP 5.2 mandatory identifiers in court filings
FRCP 5.2 mandates redaction of specific identifiers in any document filed with a federal court:
- Social Security and taxpayer identification numbers: show only the last four digits
- Financial account numbers: show only the last four digits
- Dates of birth: show only the year
- Names of minor children: show only the initials
- Home addresses in criminal cases: show only the city and state
This rule applies to documents that are actually filed with the court. Documents produced to opposing counsel in discovery but not filed with the court are not automatically subject to FRCP 5.2, though the protective order may impose equivalent requirements.
Category 2: Attorney-client privilege and work product
Privileged communications between attorney and client and attorney work product are withheld or redacted from discovery productions. Work product includes mental impressions, case strategy, legal analysis, and opinions prepared in anticipation of litigation. When privileged material appears in a document that is otherwise responsive, the privileged portion is redacted and a privilege log entry is created identifying the document, the date, the author, the recipients, and the privilege claimed. Producing a document without the privilege log entry for the redacted portion can result in a finding of waiver.
Category 3: Protective order scope
Most complex litigation involves a protective order that defines additional categories of confidential information. Common protective order categories include:
- Trade secrets and proprietary business information
- Financial records, pricing data, and cost structures
- Personnel files and employee evaluations
- Medical and mental health records
- Competitive intelligence and product roadmaps
The protective order governs what must be redacted or designated as confidential before production to opposing counsel. Read the operative protective order for the specific case before processing any documents. Overly broad redactions beyond what the order allows are subject to sanctions; redactions that fall short of the order's requirements breach the confidentiality obligations it creates.
The distinction between filed documents and produced documents
A critical distinction that many practitioners overlook: FRCP 5.2 identifiers must be redacted from documents filed with the court, but documents produced to the opposing party in discovery (and not filed) are governed by the protective order, not automatically by FRCP 5.2. However, if a produced document is later submitted as an exhibit in a court filing, FRCP 5.2 redactions must be applied at that point. FRCP 26 governs the overall scope of discovery, and the Sedona Conference Principles provide widely cited guidance on proportionality and privilege protection in e-discovery.
What does not require redaction
Standard facts, non-privileged communications between parties, documents produced without any protective order designation, and information that is already public are generally not redacted in discovery productions. Over-redacting responsive, non-privileged information is itself a sanctionable conduct and signals to courts that a party may be hiding relevant evidence.
